Please pay attention to the following details as they contain important information.
Definitions
- The Client - The individual, Company or group who enters into a contract with Creative Resolve.
- Project Outline - The document built by Creative Resolve, covering all aspects of the project.
- The Project - The contract between the client and creative resolve for production of multimedia assets, as covered in the Project Outline.
- Client Content - The final assets delivered to the client by Creative Resolve at the end of the project.
- Client Materials - Content and assets provided by the client for use in the project.
- Third Party Materials - Systems or content created by an external company for use in the project.
The Web Site
- This web site, it's information and content are the property of Creative Resolve and are protected by copyright law.
- The content of this web site may be used by visitors for personal reference, and is not to be reproduced either in it's entirety or in part without prior written consent from Creative Resolve.
- Creative Resolve reserves the right to alter any aspect of, or limit access to this web site at anytime.
The Project Outline
- The project outline is created to give the client a clear understanding of the work that is to be undertaken and the relative fees.
- No developmental work takes place until the project outline has been completed and agreed upon.
- Creative Resolve's services and responsibilities are limited to those covered in the project outline unless agreed and stated otherwise in writing beforehand. Creative Resolve reserves the right to demand payment for additional services requested outside of the project outline, and although will endeavour to do so is under no obligation to incorporate such services into any timescales agreed for that project.
- The Client is required to sign the project outline at the end of the project to confirm that it has been completed to a satisfactory standard.
Invoices, Quotations and Prices
- All Prices are given in GBP (Pounds Sterling) unless stated otherwise
- Invoices are valued and scheduled in accordance with the project outline. Payment of invoices must be recieved within 30 days of being issued, and Creative Resolve reserves the right to terminate the project or withhold final client content until payment for such content is recieved.
- Work on the project does not begin until a price has been agreed upon. Any additional costs which may occur as a result of changes during development are assessed, and integrated into the project outline which is adapted accordingly.
- Where neccassary, the cost of third party materials is integrated into the project proposal and invoices.
- Creative Resolve reserves the right to change any of the prices advertised on this web site without prior notification.
- Creative Resolve reserves the right to change any discount details without prior notification.
Subcontracted work
- Creative Resolve does not subcontract any of its web design or graphic design work, though services including web development, photography and printing are subcontracted to well respected associates.
- Subcontracted work is integrated into the project outline and invoices, and charged as part of the overall fee.
- The work completed by subcontractors is not under the management of Creative Resolve, therefore Creative Resolve cannot be held responsible for any delays incurred by subcontractors, and endeavours to ensure that all subcontracted work be completed within any predefined timescales.
Project Timescale and deadlines
- Creative Resolve agree's to complete all work within any pre-defined timescales. In the event of delays, or the occurance of circumstances effecting the project timescale, Creative Resolve will inform the client and if necassary will adapt the project accordingly
Refunds, Warranties and Trading
- Payments recieved for all invoices are non-refundable
- Creative Resolve does not warrant the content, accuracy or veracity of any material or other information on the Website nor does it warrant that the Website is free from errors, faults, viruses or other computer or data-corrupting/damaging materials.
- Creative Resolve is not responsible for the quality or nature of any Client Content, nor can it warrant its content or accuracy, or that it is free from errors, faults, viruses or other computer or data-corrupting or data-damaging material.
Exclusion of Liability
- To the maximum extent permitted by law the Creative Resolve excludes liability for any loss, claim, damages or any special, consequential, exemplary or punitive damages (whether directly or indirectly incurred) of any kind arising out of or in connection with any visitor's or user's access to, or use of the Website, or any content thereon, whether based in contract, or whether negligent or otherwise, even if Creative Resolve has been advised of the possibility of such damage.
